Last updated: 25 October 2026

1. Who we are

James Hancox - New Zealand Fine Art Prints is a trading name of Pinya Holdings Ltd (NZBN 9429051294960), a company registered in New Zealand.

  • Registered address: Worcester Street, Christchurch CBD, Christchurch 8011, New Zealand
  • Email: james@jameshancox.nz
  • Phone: +64 27 204 1060

In these terms, "we", "us" and "our" mean Pinya Holdings Ltd. "You" means the person using this store or buying from it.

2. These terms

These terms apply when you use jameshancox.com or buy from us. By placing an order you agree to them. If you do not agree, please do not order.

Our Privacy Policy, Refunds and Returns Policy and Shipping Policy form part of these terms. Read them together.

3. Your statutory rights are not affected

Nothing in these terms limits, excludes or restricts any right or remedy you have under the consumer law of the country where you live. That includes the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 in New Zealand, the Australian Consumer Law in Australia, the Consumer Rights Act 2015 in the United Kingdom, and the consumer protection law of your EU or EEA member state.

Where these terms conflict with your statutory rights, your statutory rights prevail.

Nothing in these terms excludes or restricts our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

4. Buying from us

  • You must be at least 16 years old, or have the consent of a parent or guardian. If you are

under 18, you confirm that you have that consent.

  • You must give accurate information, including a correct delivery address.
  • Placing an order is an offer to buy. A contract is formed when we send you an order

confirmation email, which we send promptly after you order. If we cannot accept your order, we will tell you and refund any payment in full.

  • We may decline or cancel an order where we cannot supply it, where the price or description

was clearly wrong, where we suspect fraud, or where the order appears to be for resale or commercial distribution. If we cancel after payment, we refund you in full.

  • If you are in the EU, the EEA or the UK, you have a 14-day right to cancel your order. See

our Refunds and Returns Policy for how it works and how to use it. Nothing in these terms affects that right.

  • Prices are shown in the currency selected at checkout and may change. The price that

applies to your order is the price shown at the time you place it.

  • We may limit quantities per customer or per order to keep stock fair.

5. Products and images

Colour and appearance. Every screen displays colour differently. We photograph and proof carefully, and we work with a professional print lab, but we cannot guarantee that the colour on your screen will match the print exactly. Minor variation in colour, contrast and tone between a screen image and a printed image is normal in fine art printing and is not a fault.

Descriptions and measurements. We describe formats, papers and sizes as accurately as we can. Measurements are approximate within normal print tolerances. If a print is materially different from its description, see our Refunds and Returns Policy - that is a fault and it is covered.

Editions and availability. Where a print is offered in a limited edition, the edition size is stated on the product page.

6. Copyright and licence

We own the copyright. All photographs and images on this store, and all prints we supply, are the copyright of James Hancox and Pinya Holdings Ltd. Copyright is not transferred when you buy a print.

What your purchase gives you. Buying a print gives you a perpetual, worldwide, non-exclusive licence to own and display that physical print for personal, domestic and non-commercial use. This includes displaying it in your home, in a business premises, or giving it as a gift.

What your purchase does not give you. You may not:

  • reproduce, scan, copy or photograph the print for reproduction
  • resell, sublicense or commercially distribute the print or any reproduction of it
  • use the image for advertising, product packaging, editorial publication or merchandise

without a written commercial licence

  • use the image in any AI training, generation or dataset
  • remove, obscure or alter any signature, edition marking or copyright notice

Commercial and licensing enquiries. Commercial use, editorial use, publication, installation work and wholesale are available under separate licence. Contact james@jameshancox.nz.

Our right to use your content. If you send us a review, comment or photograph, you give us permission to display it on the store and in our marketing, in connection with that content. You keep ownership of it, and you can ask us to remove it at any time.

7. Your account

You are responsible for keeping your account credentials secure, and for activity under your account. Tell us promptly if you think your account has been accessed without your permission. We may close an account that is used fraudulently or in breach of these terms.

8. Acceptable use

You must not:

  • use the store for any unlawful purpose
  • attempt to gain unauthorised access to the store, its systems or another person's data
  • introduce malware, or interfere with the operation or security of the store
  • scrape, crawl or bulk-download content, images or pricing except as permitted by our

robots.txt

  • copy, mirror or re-host the store or its images
  • misrepresent your identity, or impersonate another person
  • place orders in bad faith, including through automated means

We may suspend or refuse access where these rules are broken.

9. Third-party services and links

Our store runs on Shopify and uses third-party services for payment, fulfilment, delivery and analytics. We link to platforms and websites we do not control, including Instagram, Facebook, Pinterest and YouTube. We are not responsible for the content, availability, security or privacy practices of those third parties.

10. Availability

We aim to keep the store available, but we do not promise uninterrupted access. We may suspend, change or withdraw parts of the store for maintenance, for legal reasons, or to change what we sell. Where a change affects an order you have already placed, we will honour that order or refund it.

11. Liability

This section does not apply to consumer guarantees. Section 3 governs. A consumer's rights under the Consumer Guarantees Act 1993, the Australian Consumer Law, the Consumer Rights Act 2015 or EU member state law are not affected by this section.

Business use. If you are acquiring goods or services for business purposes, and you and we have agreed in writing that the Consumer Guarantees Act 1993 does not apply, then to the extent the law permits:

  • we provide the store and its content "as is", and we exclude all warranties and conditions

that would otherwise be implied

  • we are not liable for indirect, incidental, special or consequential loss, including loss

of profit, loss of revenue, loss of business opportunity or loss of data

  • our total liability arising out of or in connection with these terms is limited to the

amount you paid for the goods or services giving rise to the claim

Website use. To the extent the law permits, we are not liable for loss caused by your use of, or inability to use, the store, or by any content on it - except where section 3 says otherwise.

Indemnity. You agree to indemnify us against claims, losses and costs arising from your breach of these terms, your misuse of the store, or your infringement of our intellectual property. This does not apply to the extent the loss was caused by us.

12. Changes to these terms

We may update these terms. The version in force when you placed your order governs that order. The date at the top shows when the terms last changed. Continuing to use the store after a change means the new terms apply to future orders.

13. Severability

If a provision of these terms is found to be unlawful, void or unenforceable, that provision is severed and the rest continues to apply.

14. Governing law and disputes

These terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction. Nothing in this clause removes any right you have to bring a claim in your own country under its consumer law, or to use a local dispute resolution service.

Before starting formal proceedings, please contact us. Most disputes are misunderstandings that we can resolve quickly.
